1. Introduction

Hitch (hereafter referred to as "Hitch") operated by Kottakota Business Development Pvt. Ltd. & its affiliates provides an online bill payment, mobile recharge, rental payment, and vendor payment service that allows you to handle payments and recharges conveniently from home. By using our service, you agree to these terms and conditions, so please read them carefully. Periodically, we may update these terms and any modifications will be posted on our website with the revised ‘Last Updated’ date at the top of this page. We encourage you to review these terms regularly to stay informed of any changes.

2. Definitions and Glossary
  • “Service” refers to Hitch's online platform, mobile application, and related services.
  • “User” refers to any individual or entity who accesses or uses the Service.
  • “Payer” refers to the User making a payment through the Service.
  • “Payee” refers to the individual, business, or entity receiving payment through the Service.
  • “KYC” refers to Know Your Customer verification procedures.
  • “OTP” refers to One-Time Password.
  • “Transaction” refers to any payment, recharge, or fund transfer made through the Service.
3. Eligibility and Registration
  • 3.1 Eligibility Requirements
    • Users must be at least 18 years of age.
    • Users must have the legal capacity to enter into binding contracts.
    • Users must be residents of India with a valid Indian mobile number and email address.
  • 3.2 Account Registration
    • Users must register by providing accurate and complete information.
    • Users are responsible for maintaining the confidentiality of their account credentials.
    • Users agree to immediately notify Hitch of any unauthorized account access.
    • Hitch reserves the right to refuse service, terminate accounts, or cancel transactions at its discretion.
4. KYC Requirements
  • 4.1 KYC Verification Process
    • All Users must complete KYC verification conducted by Hitch before using payment services.
    • KYC verification includes, at minimum, Aadhaar (OTP-based verification) and PAN verification.
    • Hitch may request additional documentation as deemed necessary, including but not limited to:
      • GSTIN for business entities
      • Business registration certificates
      • Bank account statements
      • Address proof documents
      • Income declarations
  • 4.2 KYC Renewal
    • KYC verification might be renewed periodically by Hitch.
    • Additional verification may be required when:
      • Transaction patterns change significantly
      • Account usage raises security concerns
      • Regulatory requirements change
      • Hitch identifies unusual account activity
  • 4.3 Data Security
    • All KYC information will be stored by Hitch securely in compliance with applicable data protection laws.
    • User data will not be shared with third parties except as required for verification purposes or by law or based on the consent from the user.
5. Bill Payments and Mobile Recharges
  • 5.1 Service Availability
    • Hitch offers payment services for various utility bills, mobile recharges, and other services.
    • Service availability may vary based on location, service provider, and other factors.
  • 5.2 Transaction Process
    • Users must verify all payment details before confirming transactions.
    • Once confirmed, most transactions cannot be reversed or refunded.
    • Hitch is not responsible for incorrect information provided by Users.
  • 5.3 Transaction Limits
    • Transaction limits may apply based on KYC verification level, payment method, and regulatory requirements.
    • Limits are subject to change at Hitch's discretion or to comply with regulations.
  • 5.4 Service Charges
    • Applicable service charges will be clearly displayed before transaction confirmation.
    • Hitch reserves the right to modify service charges with prior notice.
6. Rental Payments
  • 6.1 Valid Lease Requirement
    • All rental payments require proof of a valid lease/rental agreement between payer and payee.
    • The lease agreement must include essential terms such as:
      • Duration of lease
      • Payment schedule and amounts
      • Property details
      • Termination clauses
      • Both parties' identification details
  • 6.2 Verification of Rental Agreements
    • Hitch reserves the right to verify the authenticity of rental agreements.
    • Payees may be required to provide documentation confirming property ownership or management authority.
    • Hitch may delay or decline processing payments where verification cannot be completed satisfactorily.
  • 6.3 Payment Schedule
    • Users may set up recurring rental payments according to their lease agreements.
    • Users remain responsible for ensuring sufficient funds are available for scheduled payments.
    • Failure of scheduled payments due to insufficient funds remains the User's responsibility.
  • 6.4 Prohibitions/Restrictions
    • Non availability of the Rental Agreement may lead to restrictions on the amount that could be paid by the users through the Platform. Such restrictions, if any, shall be informed to the user through the platform.
    • Self-payments or payments to self-owned accounts shall not be permitted.
  • 6.5 Rent Payment Disputes
    • Disputes regarding rental amounts, property conditions, or lease terms must be resolved directly between payer and payee.
    • Hitch acts solely as a payment facilitator and not as an arbitrator of rental disputes.
    • Documentation of payments processed through Hitch will be provided upon request for dispute resolution purposes.
7. Vendor Payments
  • 7.1 Pre-Delivery Confirmation
    • Users must confirm receipt of goods/services against which the payment is initiated or achievement of the applicable milestone, if the payments are made against pre-defined milestones, before initiating vendor payments through the platform.
  • 7.2 Invoice Requirements
    • All vendor payments require submission of invoices containing:
      • Vendor's GSTIN, wherever applicable
      • Nature of goods/services procured
      • Delivery confirmation or proof of service
      • Valid invoice number and date
  • 7.3 Prohibitions/Restrictions
    • Non availability of the invoice may lead to restrictions on the amount that could be paid by the users through the Platform. Such restrictions, if any, shall be informed to the user through the platform.
    • The following types of vendor payments are prohibited:
      • Self-payments or payments to self-owned accounts
      • Payments for illegal goods or services
      • Payments that circumvent tax or any other statutory/regulatory obligations
  • 7.4 Vendor Verification
    • Hitch may conduct verification of vendors receiving payments through the platform.
    • Vendors receiving recurring or high-value payments may be subject to enhanced due diligence.
    • Hitch reserves the right to decline processing payments to unverified vendors.
  • 7.5 Service Responsibility
    • Hitch is not responsible for the quality, timeliness, or completion of services provided by vendors.
    • All service agreements are between the User and the vendor.
    • Users should independently verify vendor credentials and service quality.
8. Payment Methods and Processing
  • 8.1 Available Payment Methods
    • Hitch accepts various payment methods including but not limited to UPI, credit cards, debit cards, net banking, and wallet transfers.
    • Availability of payment methods may vary based on transaction type and User verification level.
  • 8.2 Payment Processing
    • Payment processing times may vary depending on the payment method, banking systems, and other factors.
    • Transactions may be subject to additional verification for security purposes.
    • Hitch is not responsible for delays caused by banking systems or third-party payment processors.
  • 8.3 Transaction Failures
    • In case of transaction failures, funds may be held temporarily before being released back to the User's account.
    • The refund timeline depends on the payment method and relevant banking policies.
    • Users should contact customer support if refunds for failed transactions are not processed within the expected timeframe.
9. Dispute Resolution Framework
  • 9.1 Service Delivery Disclaimer
    • Hitch functions solely as a payment intermediary and not as a party to the underlying transaction.
    • Hitch does not guarantee, endorse, or validate the quality of goods or services exchanged between Users.
    • Users explicitly waive rights to raise dispute/chargebacks in relation to quality or delivery of goods or services provided by the recipient for which the payment is made through Hitch’s platform once the payment confirmation is acknowledged through the platform and transaction receipts are generated and accessible to the User.
    • In the event the funds are deducted from the user’s account, and the transaction is reflecting as failed, user may raise a dispute at disputes@hitch.zone keeping CC: support@hitch.zone, by providing transaction ID (if any), date, amount, and the screenshot of the statement citing deduction of payment from the account. Such payment disputes should be reported within 72 hours of transaction completion. Hitch will investigate disputes and provide a resolution within 30 business days.
10. Roles and Responsibilities
  • 10.1 Specific Disclaimers
    • Hitch explicitly disclaims responsibility for:
      • Quality, safety, or habitability of rented properties
      • Vendor service delivery standards or timelines
      • Contractual obligations between payers and payees
      • Tax compliance of transactions between parties
      • Accuracy of information provided by Users or third parties
  • 10.2 Service Agreement Documentation
    • Users must maintain separate records of service agreements and delivery proofs.
    • Hitch may request this documentation in case of disputes but bears no responsibility for their content or enforcement.
    • Hitch shall maintain Transaction records for the period required under applicable laws.
  • 10.3 No Agency Relationship
    • No agency, partnership, joint venture, or employment relationship is created between Hitch and any User as a result of these Terms and Conditions or use of the Service.
11. Security and Privacy
  • 11.1 Data Security
    • Hitch implements industry-standard security measures to protect User information.
    • Users are responsible for maintaining the security of their account credentials.
    • Users must immediately report any suspected unauthorized access to their account.
  • 11.2 Privacy Policy
    • Hitch's Privacy Policy, available at https://www.hitch.zone/privacy-policy, governs the collection, use, and disclosure of User information.
    • By using the Service, Users consent to the practices described in the Privacy Policy.
  • 11.3 Data Sharing
    • User data may be shared with third parties as required for:
      • Payment processing
      • KYC verification
      • Fraud prevention
      • Compliance with legal requirements
      • Service improvement
12. Intellectual Property
  • 12.1 Ownership
    • All intellectual property rights in the Service, including but not limited to software, logos, trademarks, and content, belong to Hitch or its licensors.
  • 12.2 Limited License
    • Hitch grants Users a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
    • Users may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent.
13. Limitation of Liability
  • 13.1 Service Limitations
    • Hitch provides the Service on an "as is" and "as available" basis without warranties of any kind.
    • Hitch does not guarantee uninterrupted, secure, or error-free operation of the Service.
  • 13.2 Liability Cap
    • To the maximum extent permitted by law, Hitch's liability for any claims arising from the use of the Service shall not exceed the amount paid by the User for the specific transaction giving rise to the claim.
  • 13.3 Indirect Damages
    • In no event shall Hitch be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue.
14. Indemnification
  • Users agree to indemnify, defend, and hold harmless Hitch, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
    • Violation of these Terms and Conditions
    • Misuse of the Service
    • Violation of any rights of a third party
    • Violation of any applicable law or regulation
15. Termination
  • 15.1 Termination by User
    • Users may terminate their account at any time by following the instructions in the account settings.
    • Termination does not relieve Users of obligations incurred prior to termination.
  • 15.2 Termination by Hitch
    • Hitch may terminate or suspend User accounts for violations of these Terms and Conditions.
    • Hitch may terminate or suspend accounts for suspected fraudulent activity without prior notice.
    • Hitch reserves the right to refuse service to anyone at its discretion.
16. Governing Law and Dispute Resolution
  • 16.1 Governing Law
    • These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
    • Above offerings shall be subject to change if and when there is a change in the governing laws.
  • 16.2 Dispute Resolution
    • Any dispute arising out of or in connection with these Terms and Conditions shall first be attempted to be resolved through mutual discussion.
    • If unresolved within 30 days, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.
    • The arbitration shall be conducted in English by a sole arbitrator appointed by Hitch.
    • The venue of arbitration shall be Bangalore, India.
17. Amendments to Terms and Conditions
  • 17.1 Modification Rights
    • Hitch reserves the right to modify these Terms and Conditions at any time.
    • Modifications will be effective upon posting on the Hitch website or app with the updated "Last Updated" date.
  • 17.2 User Notification
    • Hitch will make reasonable efforts to notify Users of material changes to these Terms and Conditions.
    • Continued use of the Service after modifications constitutes acceptance of the updated Terms and Conditions.
18. Severability
  • If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms and Conditions shall otherwise remain in full force and effect.
19. Force Majeure
  • Hitch shall not be liable for any failure to perform its obligations where such failure is a result of acts of nature, government actions, war, civil disturbance, or any other cause beyond the reasonable control of Hitch.
